    \r\n    
    1) Cancellation Terms<\/h2>\r\n    
    \r\n      Cancellations are, of course, very unfortunate, but may be made in writing by the organiser at any time.\r\n      The decisive date of cancellation is the day on which the cancellation has been demonstrably received by the artist.\r\n      For cancellations up to 30 days before the event, no cancellation fees will be charged.\r\n      For cancellations less than 30 days before the event, cancellation fees or a contractual penalty amounting to 50% of the agreed performance fee will be charged.\r\n      If cancellation occurs within 7 days before the event, cancellation fees amounting to 100% of the agreed performance fee will apply.\r\n      Thank you kindly for your understanding.\r\n    <\/p>\r\n    
    \r\n      Cancellations or postponements due to unforeseeable events or force majeure (for example Covid-19) shall, of course, not result in any cancellation fees.\r\n      In such cases, timely contact is kindly requested in order to discuss the further course of action on a case-by-case basis.\r\n      Cancellations by the artist have never occurred so far, but may be made in writing at any time for good cause.\r\n      Any amounts already transferred will be refunded in full.\r\n      Any claim for damages or cancellation fees is generally excluded.\r\n      Costs and expenses already incurred by the organiser cannot be reimbursed.\r\n    <\/p>\r\n  <\/section>\r\n\r\n  
    \r\n    
    2) Payment Terms<\/h2>\r\n    
    \r\n      The full fee (including travel expenses) will be invoiced after the event and is payable in cash directly on the day of the event after the performance,\r\n      or alternatively by bank transfer in full no later than 14 days after receipt of the invoice.\r\n      If the artist\u2019s fee is not paid on time, a payment reminder will be issued.\r\n      After a further 14 days, a supplementary fee of 10% of the agreed artist fee will be charged with the second reminder.\r\n      If no payment is still received, further action will be taken through legal channels after 7 days (including reminder fees).\r\n      Please clarify in advance which payment method (cash \/ bank transfer \/ in advance \/ after the event) is preferred.\r\n    <\/p>\r\n    
    \r\n      Otherwise, please transfer the agreed invoice amount after receipt of the invoice, without deduction and stating the invoice number as the payment reference, within the payment period to the following account:\r\n      Account holder: Benjamin Sauseng - Magician

    3) Liability<\/h2>\r\n    
    \r\n      The artist is liable exclusively for damages caused intentionally or by gross negligence.\r\n      Liability for slight negligence as well as for property damage or injuries caused by spectators or employees of the client during the event is excluded to the extent permitted by law.\r\n    <\/p>\r\n  <\/section>\r\n\r\n  
    \r\n    
    4) Artist Unavailability \/ Changes<\/h2>\r\n    
    \r\n      In the event of an unforeseen cancellation due to illness or similar reasons, the artist undertakes to inform the organiser immediately and, if necessary, to present a medical certificate.\r\n      Any amounts already transferred will be refunded in full, or an alternative date \/ substitute artist (of equal quality and under the same conditions) will be offered.\r\n      Any claim for damages is generally excluded.\r\n    <\/p>\r\n    
    \r\n      The artist reserves the right to make substitutions or changes (for important reasons) regarding the performing artist.\r\n      In such cases, the organiser will be informed in good time, and in the event of a replacement, the same quality and the same conditions will be provided at all times.\r\n    <\/p>\r\n  <\/section>\r\n\r\n  
    \r\n    
    5) Performance Requirements<\/h2>\r\n    
      \r\n      
    • Sufficient time for setup and takedown<\/li>\r\n      
    • A reachable contact person on site. For stage performances, a stage technician \/ knowledgeable person<\/li>\r\n      
    • Dressing room: a separate room away from the event area for preparation or changing \/ a secure place to store equipment<\/li>\r\n      
    • Parking \/ loading possibility for the artist on site<\/li>\r\n      
    • Access to a power outlet<\/li>\r\n      
    • 1 chair or small table<\/li>\r\n      
    • During and before the event, the organiser shall provide non-alcoholic drinks and a snack<\/li>\r\n      
    • Advertising and poster placement will, if needed, be handled by the organiser; promotional materials (press photos \/ texts) will, if needed, be provided by the artist<\/li>\r\n      
    • One week before the event, the number of guests must be communicated, if possible (+\/- 10 persons)<\/li>\r\n      
    • For a stage act with 100 or more people: elevation of at least three stage elements (3x2m) and the possibility to connect a headset \/ microphone to a sound system (XLR) (upon agreement)<\/li>\r\n      
    • For a stage act with 200 or more people: camera operator with live transmission via projector onto a screen (upon agreement)<\/li>\r\n      
    • The organiser bears any event \/ hall-related costs (e.g. rent, operating costs, personnel costs, etc.). The organiser is also responsible for acquiring any performance licence for any music used and paying any applicable AKM fees.<\/li>\r\n      
    • (By further agreement: provision of sound \/ lighting equipment, microphones, camera, or other stage equipment)<\/li>\r\n    <\/ul>\r\n    
      \r\n      WARNING: In the event of serious breaches of contract, unreasonable performance conditions, or circumstances that do not correspond to the agreed conditions,\r\n      the artist is entitled to stop the performance.\r\n      In this case, the claim to the full agreed fee remains in force.\r\n      This also applies to politically \/ religiously motivated events (without prior disclosure), severe intoxication of the audience,\r\n      threats \/ acts of violence, or theft of the artist\u2019s property.\r\n      Cases of proven force majeure are of course excluded from this (place of jurisdiction: Graz, Styria, Austria, insofar as legally permissible).\r\n    <\/p>\r\n    
      \r\n      Additional requirements \/ conditions must be discussed in good time in advance.\r\n      The artist further reserves the right to freely choose the specific design of the presentation and performance of his program,\r\n      while the wishes and ideas of the organiser will be taken into account at all times within the scope of what is feasible.\r\n      Special requests and specific concerns must therefore be discussed in good time before the event.\r\n    <\/p>\r\n  <\/section>\r\n\r\n

      6) Insurance<\/h2>\r\n    
      \r\n      The artist has public liability insurance which, in the event of damage (for example caused by fire or similar), is covered up to a sum of EUR 2 million.\r\n    <\/p>\r\n  <\/section>\r\n\r\n  
      \r\n    
      7) Privacy & References<\/h2>\r\n    
      \r\n      The organiser agrees that their data, such as first and last name (and, where applicable, company address), address, date of birth, tax number,\r\n      telephone number and email address, may be processed and stored for the purposes of contract handling \/ invoicing and maintaining a business partner database.\r\n      This consent may be revoked in writing by the organiser at any time.\r\n    <\/p>\r\n    
      \r\n      Furthermore, the organiser (in the case of a corporate booking) agrees that the artist is authorised to use the client\u2019s name and\/or company logo (brand)\r\n      as well as any letters of reference and services performed free of charge as a reference for marketing \/ self-promotion purposes.\r\n    <\/p>\r\n  <\/section>\r\n\r\n  
      \r\n    
      8) Media Rights<\/h2>\r\n    
      \r\n      The organiser is entitled to create photographs, films and sound recordings of the performance and to publish them for their own promotional purposes.\r\n      Published film material may not exceed three minutes in length and must be provided to the artist for review before publication.\r\n      The artist would be very pleased to receive recorded photos\/videos, together with the corresponding usage rights (website \/ social media), for self-promotion after the performance free of charge.\r\n    <\/p>\r\n    
      \r\n      In addition, the artist is permitted to take photo\/video material during the event for self-promotion purposes,\r\n      provided that such material does not disclose any trade secrets or otherwise infringe data protection requirements.\r\n      Any concerns in this regard should be discussed with the artist in advance.\r\n    <\/p>\r\n  <\/section>\r\n\r\n  
      \r\n    
      10) Confidentiality of the Fee<\/h2>\r\n    
      \r\n      Both parties undertake to maintain strict confidentiality regarding the agreed fee for the performance.\r\n      The fee as well as all financial agreements set out in this contract may not be disclosed or revealed to third parties without the express written consent of the other party.\r\n      This confidentiality obligation shall remain in force even after the termination or cancellation of this agreement.\r\n    <\/p>\r\n  <\/section>\r\n<\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
